These Terms of Service (“Terms”) govern your enrollment in and use of the Tenant Content Coverage Program (“the Program”), administered by Swain & Baldwin, Inc. (“Swain & Baldwin,” the “agency,” “we,” “us”) on behalf of participating property owners. By accessing this website or enrolling, you agree to be bound by these Terms. Please read them together with our Privacy Policy and the insurance policy documents issued to you. We may modify these Terms at any time; changes appear here and are effective when posted, so please check this page when you use the site.

1. The coverage

The Program provides personal-property (contents) insurance for your belongings inside your apartment unit. The insurance is underwritten and issued by a licensed insurance carrier. Swain & Baldwin administers enrollment, billing, and claims intake; it is the agency, not the insurer. The carrier's policy documents define the actual coverage, deductibles, exclusions, and conditions that apply to you.

2. Eligibility

Enrollment is open to residents of participating properties who are 18 or older. You must provide accurate enrollment information, including your correct property and unit. Coverage applies to the enrolled resident's belongings as described in the policy documents.

3. Payment and renewal

Premiums are billed through Stripe at the frequency you select — monthly or annual. Annual billing charges eleven months at the monthly rate (one month free). Coverage renews automatically at the then-current rate until you cancel. You authorize recurring charges to your payment method until cancellation. If a payment fails, your coverage may lapse after any applicable grace period. We will give notice of any price change as required by law.

4. Coverage limits and deductibles

Coverage is limited to the protection amount you selected at enrollment — $2,500, $5,000, or $10,000 — and is subject to the deductibles, sub-limits, exclusions, and conditions stated in your policy documents. Higher tiers are available; you may change tiers as permitted by the carrier.

5. Claims

To file a claim, contact support and provide the requested documentation, such as photos and receipts. Claims are reviewed and paid according to the terms of your policy. Filing a claim does not guarantee payment; coverage determinations are made under the policy documents.

6. Cancellation and refunds

You may cancel your coverage at any time from your account or by contacting support. Cancellation stops future renewals; any refund of amounts already paid is governed by the terms of your policy and applicable law. Coverage also ends if required premiums are not paid.

8. Policy documents control

This website and these Terms describe the Program in general terms for your convenience. The insurance policy documents issued by the carrier are the binding contract of insurance. If anything on this site or in these Terms conflicts with those documents, the policy documents control.

9. Intellectual property

Unless otherwise noted, the content of this site is the property of Swain & Baldwin, Inc. and is protected by applicable copyright, trademark, and other intellectual-property law. You may display, download, and print content for your personal, non-commercial use only; you may not copy, modify, create derivative works from, distribute, republish, or sell it without our express written consent.

10. Third-party links

This site may link to websites owned by third parties (for example, our payment processor). We do not endorse, sponsor, or warrant those websites or their content, products, services, or privacy policies, and we are not responsible for them. Your use of any third-party site is at your own risk and subject to that site's terms.

11. Disclaimers and limitation of liability

The website and Program services are provided on an “as is” and “as available” basis, without warranty or condition of any kind, either express or implied, including as to accuracy, completeness, timeliness, non-infringement, merchantability, or fitness for a particular purpose. Your use of this site is at your own risk. To the fullest extent permitted by law, Swain & Baldwin and its affiliates, officers, employees, and licensors are not liable for any loss, damage, or injury arising from your use of, or inability to use, this website or from administration of the Program. Nothing in these Terms limits the insurance benefits owed to you under your policy documents or any rights that cannot be waived under law.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, except where the insurance contract specifies otherwise.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued enrollment after a change means you accept the updated Terms.
